These Terms of Service (“Terms”) form a legally binding contract between you (either as an individual or on behalf of the company or legal entity you represent) and Adsvise Co. governing your access to and use of https://adsvise.me, our web speed auditing tools, Core Web Vitals telemetry, dashboards, and associated software services.
By accessing our website, entering a URL for diagnostic scanning, or subscribing to any paid plan, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must immediately cease accessing or using our services.
Adsvise provides intelligent creative and speed analytics that help publishers, marketers, and web engineering teams measure, diagnose, and optimize digital performance. Our platform encompasses:
- Synthetic Web Audits: Automated scans measuring Core Web Vitals (including Largest Contentful Paint [LCP], Cumulative Layout Shift [CLS], Interaction to Next Paint [INP], and First Contentful Paint [FCP]).
- Third-Party Tag & Ad Load Impact Analysis: Real-time breakdowns measuring latency, CPU blocking time, and payload weight introduced by marketing pixels, trackers, and ad networks.
- Speed Index & Revenue Simulation: Benchmark tools that estimate potential conversion, ad viewability, and revenue lifts corresponding to reductions in load latency.
- Monitoring & Alerts: Scheduled recurrent scans and regression detection for enterprise subscribers.
Important Technical Notice: Performance audits are computed using standardized synthetic browser nodes and public web probes. Real-world end-user speed is affected by geographic routing, ISP variability, mobile hardware capabilities, and client-side extensions. Audits provide benchmark assessments and do not guarantee identical client metrics across every visitor session.
You agree to use Adsvise only for lawful purposes and in adherence to these Terms. You specifically represent and warrant that:
- You will only submit URLs and domains that you own, operate, or have express authorization to test and evaluate.
- You will not use Adsvise to launch Distributed Denial of Service (DDoS) attacks, flood server endpoints with abusive request volumes, or intentionally disrupt target host infrastructure.
- You will not scrape, bulk-extract, or circumvent our API rate limits or automated bot-protection mechanisms without written consent from Adsvise.
- You will not reverse engineer, decompile, or disassemble our speed measurement algorithms or proprietary weighting indices.
- You will not misrepresent benchmark outputs or issue deceptive performance certifications using our brand identity.
We maintain automated rate limiting and security telemetry. We reserve the right to immediately throttle, suspend, or permanently terminate access for any IP address or account found in breach of this Fair Use Policy.
Certain features, including saved historical audit timelines and multi-domain monitoring, require creating an Adsvise account. If you register an account:
- You must provide accurate, current, and complete registration details.
- You are solely responsible for safeguarding the credentials associated with your account and for all activities that occur thereunder.
- You must notify us immediately at security@adsvise.com upon discovering any unauthorized breach or compromise of your account.
Adsvise reserves the right to suspend or terminate accounts that remain inactive for extended durations or violate our service guidelines.
Adsvise offers complimentary standalone speed audits alongside premium subscription tiers with advanced capacity.
- Payment Processing: All payment transactions, recurring charges, and tax assessments are processed securely through our payment provider, Stripe, Inc. By purchasing a subscription, you authorize Stripe to charge your designated payment method for all applicable fees. Adsvise never stores your full credit card credentials on our servers.
- Billing Cycles: Subscriptions are billed in advance on a recurring monthly or annual basis starting on the date of activation. Subscriptions automatically renew unless cancelled prior to the renewal date.
- Plan Upgrades & Downgrades: Upgrades take effect immediately, with prorated credit applied to your renewal invoice. Downgrades take effect at the conclusion of your current prepaid billing cycle.
- Cancellation Policy: You may cancel your subscription at any time directly through your account dashboard or by submitting a request to hello@adsvise.com. Cancellation halts future renewal charges, and you retain access to paid features until the expiration of your prepaid period.
- Refund Policy: Except as required by mandatory consumer protection law, all fees are non-refundable once billed. We encourage all users to test their websites with our complimentary scans prior to upgrading.
Adsvise Property: The platform, website design, trademarks, service marks, graphics, visual layout, source code, data visualizations, and software systems are the exclusive property of Adsvise Co. and are protected by international copyright, trademark, and trade secret laws.
Your Property: You retain complete and unencumbered ownership of your websites, domains, marketing materials, and digital assets submitted for testing. By submitting a URL for audit, you grant Adsvise a limited, non-exclusive license solely to retrieve, execute, and inspect public assets for the purpose of generating your diagnostic report.
Feedback: If you provide suggestions, feature ideas, or feedback to Adsvise, we may freely use and incorporate such feedback into our products without restriction, royalty, or attribution obligations.
Our speed diagnostics analyze scripts, tags, and assets loaded by third-party ad networks, CDNs, analytics suites, and content management systems (such as Google Ad Manager, Meta Pixel, Cloudflare, AppNexus, and similar services).
All trademarks, company names, product names, and brand identifiers referenced in audit reports belong entirely to their respective holders. The inclusion of any third-party script name or performance evaluation does not imply affiliation with, sponsorship of, or endorsement by Adsvise, nor endorsement of Adsvise by those entities.
THE ADSVISE PLATFORM, TOOLS, AUDIT METRICS, AND ALL ASSOCIATED CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADSVISE CO. SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.
Commercial Results Disclaimer: Adsvise provides performance intelligence based on industry benchmarks. We make no representations or guarantees that optimizing load speed will directly result in higher ad revenue, search engine position gains, or increased conversion sales.
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL ADSVISE CO., ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR INABILITY TO USE THE SERVICES.
IN NO EVENT SHALL ADSVISE CO.’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100 USD) OR THE TOTAL AMOUNT PAID BY YOU TO ADSVISE DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.
You agree to defend, indemnify, and hold harmless Adsvise Co., its corporate parents, subsidiaries, officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, expenses, or costs (including reasonable legal and attorneys’ fees) arising out of or related to:
- Your access to, misuse of, or conduct upon the Adsvise platform;
- Your violation of any provision of these Terms or applicable local, state, national, or international regulations;
- Audits conducted on domains where you lacked lawful authorization;
- Your infringement of any third-party intellectual property or privacy right.
We may periodically update, refine, or revise these Terms of Service to reflect enhancements in technology, service features, or regulatory standards. If we implement material modifications, we will post the revised terms here and update the “Effective Date” at the top of this document.
Your continued use of the platform following the publication of revised terms constitutes your explicit agreement and consent to the updated terms. If you do not agree to the revisions, you must discontinue using our services.
These Terms and any dispute or controversy arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any dispute, claim, or controversy shall first be submitted to informal resolution by contacting legal@adsvise.com. If the dispute is not resolved within forty-five (45) days, it shall be resolved by binding individual arbitration conducted under the rules of the American Arbitration Association (AAA), rather than in court, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
